Marketplace Terms

These Marketplace Terms apply to SIDELINE Marketplace, operated by Sideline App LLC ("SIDELINE," "we," or "us"). They supplement the existing Terms of Service and Privacy Policy. If you do not agree, do not use Marketplace.
1. Limited platform role
Marketplace V1 is a listing and communication platform only. SIDELINE is not a buyer, seller, agent, broker, auctioneer, payment processor, escrow service, shipper, or guarantor. We do not take title to listed items, hold funds, process payments, arrange shipping, or complete exchanges on your behalf.
2. Independent transactions
Buyers, sellers, and donors arrange price, payment, pickup, shipping, inspection, and delivery independently. Off-platform payments and exchanges are not processed, protected, refunded, insured, or guaranteed by SIDELINE. Marketplace V1 does not include checkout, refunds, payment protection, escrow, or platform-managed delivery.
3. No guarantees
SIDELINE does not guarantee product quality, condition, authenticity, safety, legality, fitness for a particular use, or that any transaction will be completed. Listings are created by independent users. We do not independently inspect items or verify that a seller owns them.
4. Buyer responsibility
Buyers are responsible for inspecting items, asking questions, and deciding whether an item is suitable before paying or taking possession. Review photos and descriptions carefully. Confirm size, condition, wear, and safety for the intended athlete. Do not share unnecessary personal information.
5. Seller responsibility
Sellers are responsible for accurate descriptions, lawful ownership, truthful photos, and honest statements about condition, defects, recalls, and safety. Do not list items you do not have the right to sell or donate. Donations remain free of SIDELINE transaction fees and must still follow these terms.
6. Assumption of risk
Ordinary marketplace activity involves risk, including in-person meeting safety, payment fraud, shipping loss or delay, damaged or misdescribed equipment, and injury from product use. To the extent permitted by law, you assume those ordinary transaction risks when you use Marketplace. Meet in a safe public location for local exchanges. Inspect items before paying. Be cautious of unusual payment requests.
7. Disclaimer of warranties
Marketplace is provided "as is" and "as available." To the fullest extent permitted by law, SIDELINE disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings, messages, or the service will be uninterrupted, error-free, or free of harmful content.
8. Limitation of liability
To the fullest extent permitted by law, Sideline App LLC and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost money, lost items, personal injury, or disputes arising from independent user transactions. Our liability for Marketplace, if any, is limited to the amount you paid SIDELINE for Marketplace features, which is currently zero. This does not limit liability that cannot be limited under applicable law.
9. Rights you keep
These terms do not eliminate all legal responsibility and do not waive rights that cannot be waived under applicable law. SIDELINE does not disclaim its own legally non-waivable duties. Nothing here is a warranty, insurance policy, or attorney approval.
10. Prohibited items
Do not list illegal, counterfeit, stolen, recalled, hazardous, or otherwise unsafe items. Also prohibited: weapons; alcohol, tobacco, or drugs; prescription medication; adult products; and unsafe or damaged protective equipment that should not be reused.
11. Moderation and reporting
SIDELINE may review, hide, reject, or remove listings and may limit Marketplace access when we believe content is unsafe, misleading, prohibited, or otherwise harmful. Reports do not automatically remove a listing. Members should report suspected fraud, stolen goods, or unsafe items.
12. Adult eligibility
Only people 18 or older may create listings, contact sellers, or arrange Marketplace exchanges. SIDELINE does not independently verify identity or age. You are responsible for the accuracy of your acknowledgment.
13. Privacy and messages
Personal information and private buyer-seller messages are handled according to our Privacy Policy. Do not publicly post home addresses, private emails, or phone numbers. Authorized SIDELINE administrators may review messages when needed for safety or moderation.
14. Other SIDELINE terms
The site-wide Terms of Service continue to apply, including account rules and the existing limitation of liability. These Marketplace Terms add Marketplace-specific rules. They do not create a new governing-law, venue, arbitration, or dispute-resolution process.
